By downloading, installing, or using the Gott SafeCall mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User") and Gott Technologies LATAM ("Company," "we," "us," or "our"), with registered operations in Mexico.

Gott SafeCall is a mobile application designed to protect elderly adults by detecting incoming calls from unknown numbers (numbers not saved in the device's contact list). When such a call is accepted, the App automatically sends escalating notifications to pre-selected emergency contacts (up to 3) via WhatsApp and/or SMS at timed intervals (T+0s, T+30s, T+60s) to alert them of the potential risk.

You must be at least 18 years of age to create an account and use Gott SafeCall. If you are setting up the App on behalf of another person (such as an elderly family member), you represent that you have the legal authority to accept these Terms on their behalf and that you have obtained their consent.

To use Gott SafeCall, you must create an account using Google Sign-In or phone number verification (OTP). You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

Gott SafeCall requires the following device permissions to function properly:

• READ_CONTACTS — to identify known contacts (whitelist) and prevent false alerts.
• READ_PHONE_STATE — to detect incoming, active, and ended call states.
• READ_CALL_LOG — to identify the calling number and cross-reference it against saved contacts.
• FOREGROUND_SERVICE — to keep the call monitoring service running in the background.
• SYSTEM_ALERT_WINDOW — to display alerts over other apps when necessary.

Denying any of these permissions may prevent the App from functioning correctly. You may revoke permissions at any time through your device settings, but doing so may disable core features of the App.

Gott SafeCall may offer subscription-based plans managed through the Google Play Billing system. By subscribing, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Google Play account settings. Refunds are handled in accordance with Google Play's refund policies.

You agree to use Gott SafeCall only for its intended purpose of personal safety and fraud prevention. You shall not:

• Use the App to harass, stalk, or monitor any person without their knowledge and consent.
• Attempt to reverse-engineer, decompile, disassemble, or modify the App or its source code.
• Use the App for any unlawful, fraudulent, or malicious purpose.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Distribute, sublicense, or resell access to the App.

You are solely responsible for selecting and maintaining your emergency contacts within the App. You must ensure that you have obtained consent from each emergency contact before adding them. Gott Technologies is not responsible for the availability, responsiveness, or actions of your emergency contacts. The App is not a substitute for emergency services (such as 911 or local equivalents).

Gott SafeCall uses WhatsApp Business API and SMS (via Twilio) to send alert notifications to emergency contacts. Message delivery depends on third-party services and network conditions beyond our control. We do not guarantee delivery of every notification. Standard messaging rates from your carrier may apply to SMS messages.

All content, features, and functionality of Gott SafeCall — including but not limited to the software, design, text, graphics, logos, and trademarks — are owned by Gott Technologies LATAM and are protected by Mexican and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

GOTT SAFECALL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or completely secure. The App is a supplementary safety tool and does not replace professional security services or emergency response systems.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOTT TECHNOLOGIES LATAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total cumulative liability shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Gott Technologies LATAM, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third party's rights.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Gott SafeCall after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.

We may suspend or terminate your access to Gott SafeCall at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App's settings. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) shall survive.

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico). Any disputes arising from these Terms or your use of Gott SafeCall shall be subject to the exclusive jurisdiction of the competent courts located in Monterrey, Nuevo Leon, Mexico.
