By downloading, installing, or using the Gott SafeCall mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User") and Gott Technologies LATAM ("Company," "we," "us," or "our"), with registered operations in Mexico.
Gott SafeCall is a mobile application designed to protect elderly adults by detecting calls involving unknown numbers (numbers not saved in the device's contact list). The App monitors incoming calls from unknown numbers. When such a call is detected, the App automatically sends escalating alert notifications via WhatsApp to pre-selected emergency contacts (up to 3) at timed intervals:
Alerts are only sent when the user answers the call. If the call is missed or rejected, a single post-call notification is sent to inform contacts.
You must be at least 18 years of age to create an account and use Gott SafeCall. During registration you are asked for your year of birth so we can confirm this requirement; accounts that do not meet the minimum age cannot be created. If you are setting up the App on behalf of another person (such as an elderly family member), you represent that you have the legal authority to accept these Terms on their behalf, that you have obtained their consent, and that the year of birth you provide corresponds to the person who will use the App.
To use Gott SafeCall, you must create an account using phone number verification (OTP via SMS). Registration requires your first name, last name, year of birth, and phone number. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete. How we handle this information — including the fact that your year of birth is only ever used in aggregate age ranges for analytics — is described in our Privacy Policy.
Gott SafeCall requires the following device permissions to function properly:
Additionally, the App requests that you disable battery optimization and enable call waiting on your device to ensure reliable call detection and alert delivery.
Denying any of these permissions may prevent the App from functioning correctly. You may revoke permissions at any time through your device settings, but doing so may disable core features of the App.
Gott SafeCall offers monthly and annual subscription plans managed through the Google Play Billing system. New subscribers are eligible for a 7-day free trial; unless cancelled before the trial ends, the subscription automatically converts to a paid plan and you will be charged the applicable price. By subscribing, you agree to the pricing and payment terms presented by Google Play at the time of purchase. Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel directly within the App (Settings → Manage Subscription → Cancel), in which case we submit the cancellation to Google Play on your behalf; you may also cancel at any time from your Google Play account. In either case, cancelling stops future renewals but does not end your current billing period: you keep access to paid features until the period you already paid for expires, and no partial refunds are issued for the remaining time. When cancelling inside the App you are asked to select a reason; this feedback is stored and used in aggregate to improve the service, as described in our Privacy Policy. Plan changes (monthly ↔ annual) are processed by Google Play, which prorates the charge. Refunds are handled in accordance with Google Play's refund policies.
You agree to use Gott SafeCall only for its intended purpose of personal safety and fraud prevention. You shall not:
You are solely responsible for selecting and maintaining your emergency contacts within the App. You must ensure that you have obtained explicit consent from each emergency contact before adding them. By adding a contact, you confirm that:
To discourage misuse, your list of emergency contacts may generally be changed only once per calendar month.
Gott Technologies is not responsible for the availability, responsiveness, or actions of your emergency contacts. The App is not a substitute for emergency services (such as 911 or local equivalents).
Gott SafeCall uses the WhatsApp Business API (Meta Cloud API) to send alert notifications to your emergency contacts via WhatsApp. Message delivery depends on third-party services (Meta, mobile carriers) and network conditions beyond our control. We do not guarantee delivery of every notification. The phone number used to send alerts is exclusively for automated notifications — responses to that number are not monitored.
All content, features, and functionality of Gott SafeCall — including but not limited to the software, design, text, graphics, logos, and trademarks — are owned by Gott Technologies LATAM and are protected by Mexican and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
GOTT SAFECALL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or completely secure. The App is a supplementary safety tool and does not replace professional security services or emergency response systems.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOTT TECHNOLOGIES LATAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total cumulative liability shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Gott Technologies LATAM, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Gott SafeCall after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.
We may suspend or terminate your access to Gott SafeCall at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App's settings. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico). Any disputes arising from these Terms or your use of Gott SafeCall shall be subject to the exclusive jurisdiction of the competent courts located in Monterrey, Nuevo Leon, Mexico.
These Terms of Service are published in English and in Spanish. The English version is the governing version. The Spanish text is provided as a courtesy translation for our users in Mexico; in the event of any discrepancy, ambiguity or conflict between the two versions, this English text prevails.
